EIS Process

What is an EIS?

An Environmental Impact Statement (EIS) is a detailed document required under the National Environmental Policy Act (NEPA) for federal actions that may significantly affect the quality of the human environment. It outlines the potential environmental impacts, both positive and negative, of a proposed project and evaluates alternative actions.

What is NEPA and why is an EIS required?

NEPA is a federal law that ensures environmental factors are considered in decision-making by federal agencies. An EIS is required when a proposed action may result in significant environmental impacts. The EIS process promotes transparency, informed decision-making, and public involvement.

Steps in the EIS Process

  • Notice of Intent (NOI) – Initiates the EIS process and opens the scoping period.
  • Scoping – Public, tribal, and agency input is gathered to shape the scope of the EIS.
  • Draft EIS (DEIS) – Released for public review and comment (typically 45 days).
  • Final EIS (FEIS) – Incorporates public comments and is published for review (minimum 30-day waiting period).
  • Record of Decision (ROD) – USACE issues a decision to approve, modify, or deny the permit.

Roles of USACE, CPAI, Cooperating Agencies, and the Public

  • U.S. Army Corps of Engineers (USACE): Lead federal agency responsible for preparing and overseeing the EIS
  • ConocoPhillips Alaska, Inc. (CPAI): Project applicant proposing the CD8 Development
  • Cooperating Agencies: Federal, state, or tribal entities that contribute expertise and input
  • Public: Provides comments, attends meetings, and helps shape the scope and direction of the EIS
